These Terms & Conditions explain how photography bookings, payments, image delivery, copyright, cancellations and general use of this website are handled by Marcus The Wedding Photographer.
By making an enquiry, booking a photography service, using this website, or accessing a private online gallery, you agree to the terms set out below.
Marcus The Wedding Photographer provides professional photography services in Dover, Kent and the surrounding areas.
Marcus The Wedding Photographer provides professional photography services, including wedding photography, portrait photography and other commissioned photography where agreed.
The details of each booking, including the date, time, location, coverage, collection, price and any agreed extras, will be confirmed in writing before the booking is accepted.
Photography services are provided with care, professionalism and reasonable skill.
Every reasonable effort will be made to capture the agreed coverage, but final images will depend on factors such as available light, weather, venue restrictions, timings, guest cooperation and the natural flow of the event or session.
A booking is only confirmed once the agreed booking fee, deposit or payment has been received and written confirmation has been provided.
Until a booking is confirmed, dates remain available to other clients.
For wedding bookings and other date-specific photography services, the booking secures time and availability for the agreed date.
Because of this, booking fees may be non-refundable once the date has been reserved, subject to your statutory rights, any applicable cancellation rights, and any terms agreed in writing at the time of booking.
Prices will be confirmed before booking.
The price agreed at the time of booking will apply to that booking, unless additional services, extended coverage, travel, albums, prints or other extras are later requested and agreed.
Payment dates, balances and any staged payments will be confirmed in writing.
Final balances must be paid by the agreed due date.
If payment is not received on time, Marcus The Wedding Photographer reserves the right to pause delivery of images, galleries, albums, prints or other products until payment is made in full.
If you need to cancel or postpone a booking, please contact Marcus The Wedding Photographer as soon as possible.
For date-specific services such as weddings, events or booked photography sessions, cancellation terms may depend on how close the cancellation is to the agreed date, whether work has already been carried out, whether costs have already been incurred, and whether the date can reasonably be rebooked.
Where a booking fee or deposit has been paid to reserve a specific date, this may be retained to cover reasonable losses, administration, preparation, work already carried out, or the loss of the reserved date, unless otherwise agreed in writing and subject to your statutory rights.
If a booking is postponed, Marcus The Wedding Photographer will make reasonable efforts to reschedule it to a new date, subject to availability.
If the new date is not available, the booking may be treated as a cancellation.
Nothing in these terms affects your statutory rights.
Where a booking is made online, by email, by telephone or away from business premises, you may have cancellation rights under UK consumer law.
If you ask Marcus The Wedding Photographer to begin work during any cancellation period, you may be required to pay for work already carried out. This may include consultation, planning, preparation, travel, photography, editing, gallery preparation or other services already provided.
If a service has been fully performed with your agreement, cancellation rights may no longer apply.
For digital image delivery, once digital files have been supplied, accessed or downloaded, cancellation rights may be affected.
Nothing in this section affects any rights you may have under consumer law.
Marcus The Wedding Photographer’s style is natural, romantic and real, with a calm and professional approach.
Images are selected and edited at the photographer’s discretion.
Editing may include adjustments to exposure, colour, contrast, cropping, straightening, tone, atmosphere and general presentation.
The client acknowledges that photography is a creative service and that final style, image selection and editing decisions remain with Marcus The Wedding Photographer.
Unedited RAW files are not normally supplied.
Final images are normally delivered through a private online gallery or another agreed digital method.
Delivery times may vary depending on the type and size of the booking, editing workload, seasonal demand and any additional products requested.
Marcus The Wedding Photographer will take reasonable care to deliver images promptly, but delivery dates are estimates unless specifically agreed in writing.
Clients are responsible for downloading and safely storing their own images once delivered.
Private online galleries are normally available for 12 months after delivery. After this period, the gallery may be removed and image recovery may not always be possible.
Copyright in all photographs remains with Marcus The Wedding Photographer, unless otherwise agreed in writing.
Clients receive a personal-use licence to download, print and share their purchased images for personal purposes.
Personal-use rights do not transfer copyright ownership.
Images must not be sold, edited, altered, entered into competitions, supplied to publications, used commercially, used for marketing, or used by third parties without written permission.
Wedding suppliers, venues, magazines, businesses, agencies and other third parties must request permission before using any images.

Clients may share their delivered images online for personal use.
Where possible, credit to Marcus The Wedding Photographer is appreciated.
Images should not be heavily filtered, altered, edited or changed in a way that affects the professional finish or misrepresents the work.
Screenshots, social media compression and messaging apps may reduce image quality. For best results, clients should use the supplied high-resolution files when printing or sharing important images.
Marcus The Wedding Photographer may use selected images for portfolio, website, social media, blog, editorial, competition, advertising, print or promotional purposes where this has been agreed as part of the booking process, confirmed in writing, or otherwise permitted.
If privacy is important for a particular booking, this should be discussed before the booking is confirmed.
For children, newborn, family, private or sensitive sessions, image use will be handled with particular care and sensitivity.
Clients may raise concerns about image use at any time so the matter can be reviewed.
Clients are responsible for providing accurate information before the booking, including times, locations, contact details, venue rules, access requirements, parking arrangements and any important photography requests.
For weddings and events, clients are responsible for allowing enough time in the schedule for photography.
Marcus The Wedding Photographer shall not be liable for missed images resulting from late arrivals, limited access, schedule changes, adverse weather conditions, venue restrictions, guest conduct, or directions from venue staff, registrars, celebrants, officials or other authorised persons.
Some venues and locations may have restrictions on photography, flash use, drone use, movement, access to ceremonies, or photography timings.
Marcus The Wedding Photographer will work respectfully and in accordance with the rules of each venue or location.
In outdoor photography, weather can affect the final result. Where possible, alternative photographic opportunities will be used, but weather conditions cannot be guaranteed.
Marcus The Wedding Photographer will take reasonable care when photographing, editing, storing and delivering images.
In the unlikely event of equipment failure, illness, accident, data loss or circumstances beyond reasonable control, liability will be limited to the amount paid for the affected service, unless otherwise required by law.
Marcus The Wedding Photographer is not responsible for indirect losses, loss of opportunity, or costs arising from circumstances outside reasonable control.
Nothing in these terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or rights that cannot legally be excluded.
Marcus The Wedding Photographer will take reasonable steps to store images safely for a limited period after delivery.
Clients are responsible for downloading, backing up and safely storing their own images once the gallery has been delivered.
Private galleries may not remain online indefinitely. If images are required after a gallery has expired, recovery may not always be possible.
